Unfair Dismissal UK: Compensation Explained

Losing your job unfairly can leave you out of pocket and unsure of your rights. UK employment law protects most employees from unfair dismissal, and a tribunal can award compensation. This guide explains the basics.

Who can claim?

Most employees need at least two years of continuous service to claim ordinary unfair dismissal, though some reasons, such as discrimination or whistleblowing, are protected from day one. Employment law is changing, so check GOV.UK for the current qualifying period.

What makes a dismissal fair?

A fair dismissal needs a valid reason such as conduct, capability, redundancy or a legal restriction, and a fair procedure. Employers should follow the ACAS Code of Practice, investigate properly and allow an appeal.

How compensation is calculated

An award has two main parts:

  • Basic award: calculated like statutory redundancy pay, using age, years of service and a capped weekly pay figure
  • Compensatory award: for financial loss caused by the dismissal, subject to a statutory cap or 52 weeks of pay, whichever is lower

Example: a 38-year-old with 8 full years of service earning £700 a week (capped at £751 so £700 applies) gets a basic award of 8 x 1 x £700 = £5,600. Any compensatory award for lost earnings is added on top.

Time limits and ACAS

You normally have three months less one day from the dismissal date to start a claim. Before going to a tribunal you must notify ACAS for early conciliation, which pauses the clock. Many cases settle at this stage.

Next steps

Gather your contract, dismissal letter, emails and notes of meetings. Speak to ACAS, your trade union, Citizens Advice or an employment solicitor. Compensation depends heavily on facts such as how quickly you find new work and whether you followed the process.
