Paternity Leave Key Facts

You must take your leave within 56 days of the birth.
Leave must be taken in 1 or 2 complete weeks — not odd days.
You must notify your employer 15 weeks before the due date.
Shared Parental Leave allows up to 50 weeks to be shared.
From April 2024, fathers can share some leave in the first year.

SPP Eligibility

You must be the biological father, or partner of the mother.
You must have worked for your employer for 26 weeks by week 15 before due date.
You must earn at least £123/week (Lower Earnings Limit).
You must be taking time off to care for the baby or support the mother.

Shared Parental Leave

If you want more than 2 weeks off, consider Shared Parental Leave (SPL). You and your partner can share up to 50 weeks of leave and up to 37 weeks of Statutory Shared Parental Pay — giving families much more flexibility.

FAQs

Can I take paternity leave before the birth?

No. Paternity leave can only start on or after the day the baby is born. You cannot take it before the due date.

Can I split my paternity leave?

Under current rules, your 1 or 2 weeks must be taken consecutively. However, new legislation is expected to allow more flexibility from 2025.

What if my employer doesn't pay SPP?

If your employer qualifies and refuses to pay, you can contact HMRC. Most employers can reclaim 92% of SPP payments from the government.

Is SPP taxable?

Yes, like all employment income, SPP is subject to income tax and National Insurance at your usual rates.
